These Terms of Service (“Terms”) govern your use of Dakky’s website, web app, and mobile apps (together, the “Service”). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
Operator
The Service is operated by DEVINTRY SIA, a company registered in Latvia under registration number 43603092074, with its registered office in Jelgava, Latvia. These Terms are governed by Latvian law — see Governing law below.
1. Who can use Dakky
You must be at least 18 years old (or the age of majority where you live) and a parent or legal guardian to create an account. Accounts are owned and controlled by adults; children use Dakky only through a parent’s account, under a parent’s supervision, and behind a parental gate on every link out of the app, every purchase, and every settings screen. You are responsible for activity that happens under your account.
2. The Service
Dakky generates personalized bedtime routines, stories, and narration using artificial intelligence, based on options you choose (character, setting, mood, length) and the child profile details you provide. Every generated story is filtered for child-appropriate content and labeled “Made with AI”. While our safety rules and filters are strict, AI output can occasionally be imperfect — we encourage parents to read along, and to report anything that seems off to hello@dakky.app.
3. Free tier and Dakky Plus subscription
- The free tier includes an unlimited routine, the Explore story library, and 5 free personalized narrated stories in total, available to guests and registered accounts alike. No payment details are required to start.
- Dakky Plus is our one paid plan, billed monthly (EUR 4.99) or annually (EUR 39.99, with a 7-day free trial). It unlocks story generation up to a fair-use cap of 60 stories a month, narration, and every story option.
- On iOS and Android, Dakky Plus is billed and managed as a native in-app subscription through the App Store or Google Play, under their respective terms and refund policies. On the web, Dakky Plus is billed through Stripe, our payment processor.
- Subscriptions renew automatically each billing period until canceled. Cancel anytime from your subscription settings, or through the App Store or Google Play if you subscribed there; access continues until the end of the paid period.
- Except where required by law or by store policy, payments are non-refundable for partial billing periods.
- We may change prices with at least 30 days’ advance notice; changes apply from your next billing period.
4. Printed books
You may order a printed, physical book compiling stories from your account. Printed book orders are always paid through Stripe — never through in-app purchase — regardless of platform, and sit behind the same parental gate as any other purchase. Printing and shipping are fulfilled by our print partners, Peecho or Prodigi. Shipping times and any customs or import charges outside the EU are the responsibility of the purchaser. Refunds for damaged, misprinted, or lost book orders are handled on request at hello@dakky.app; refunds for orders lost to a shipping error are our responsibility, not yours.
5. Your content and licenses
You retain ownership of the information you provide (such as child profile details). Stories generated for your family are yours to read, save, print, and share for personal, non-commercial use. You grant us the limited license needed to operate the Service — for example, storing your stories so you can re-read them, generating narration, or processing profile details to generate new stories.
6. Acceptable use
- Do not attempt to generate harmful, hateful, or sexually explicit content.
- Do not try to bypass content filters, story limits, the parental gate, or other safety measures.
- Do not reverse-engineer, scrape, or disrupt the Service.
- Do not resell or commercially redistribute generated stories.
- Do not impersonate others or provide false account information.
We may suspend or terminate accounts that violate these rules.
7. Privacy
Our Privacy Policy explains how we handle your data, including our COPPA-aligned approach to children’s information and the AI vendors we use. It is part of these Terms.
8. Intellectual property
The Service — including the Dakky name, logo, apps, and software — is owned by us or our licensors and protected by intellectual-property laws. These Terms do not grant you any rights to our trademarks or branding.
9. Disclaimers
The Service is provided “as is” and “as available”. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including fitness for a particular purpose and non-infringement. AI-generated stories are fictional entertainment and are not professional, medical, or educational advice.
10. Limitation of liability
To the fullest extent permitted by law, DEVINTRY SIA will not be liable for indirect, incidental, special, consequential, or punitive damages, or any loss of data or profits. Our total liability for any claim relating to the Service is limited to the amount you paid us in the 12 months before the claim arose (or EUR 50 if you have not paid us).
11. Termination
You may stop using the Service and delete your account at any time from the app settings or by emailing hello@dakky.app. We may suspend or terminate access for violations of these Terms, with notice where practicable. Sections that by their nature should survive termination (such as 8–10) survive.
12. Governing law
These Terms are governed by the laws of Latvia, without regard to conflict-of-law rules. Any dispute not resolved informally is subject to the exclusive jurisdiction of the courts of Latvia. If you are a consumer in the EU, this does not deprive you of the protections granted by the mandatory law of your country of residence.
13. Changes to these Terms
We may update these Terms from time to time. For material changes we will give account holders advance notice by email or in-app message. Continued use of the Service after changes take effect constitutes acceptance.
